Widerspruch: how to object to a decision (Bescheid)

If an authority sends you a decision (Bescheid) you think is wrong, you can usually object. For most authorities this is a Widerspruch; for tax decisions it is an Einspruch. The deadline is usually one month after you receive the decision, and the letter's legal notice (Rechtsbehelfsbelehrung) tells you where to send it.

Find the deadline
Read the Rechtsbehelfsbelehrung at the end of the Bescheid: it names the remedy, the deadline and the address. Note the date you received the letter.
Object in writing, in time
A short signed letter is enough to meet the deadline: who you are, which decision (date and reference number), and that you object. You can add reasons later.
Send it so you can prove it
Use registered mail, fax, the authority's online form or hand it in and get a stamp. Keep a copy.
Add your reasons
Explain what is wrong and attach proof. If you need to see your file first, ask for access (Akteneinsicht).
Get help if it matters
For benefits, residence or large tax amounts, consider a counselling service, a lawyer or a tax advisor.

Deadlines (Fristen)
- Usually one month after you receive the decision.
- If the legal notice is missing or wrong, the deadline is generally longer (usually one year). Don't rely on this without advice.
Questions and answers
Does a Widerspruch stop me from having to pay?
Not always. For many decisions, especially tax and contribution demands, you still have to pay unless the authority suspends it. You can ask for that in your letter.
