Objection to an Official Decision (Widerspruch)

Object to a decision (Bescheid) from a German authority such as the Jobcenter, Familienkasse or city: find the deadline, check the decision, send a signed Widerspruch with proof of delivery and follow up. Includes a Formulierungshilfe, not legal advice.

  1. Read the Rechtsbehelfsbelehrung

    Most decisions end with a section called Rechtsbehelfsbelehrung. It tells you which remedy applies, where to send it and how long you have. Usually it is a Widerspruch to the authority that issued the decision. Tax decisions use an Einspruch instead (see the separate template), and in some federal states and cases the letter tells you to go straight to court (Klage). Follow what your letter says.

    Note the date of the letter, the reference number (Aktenzeichen, Kundennummer or Nummer der Bedarfsgemeinschaft) and the address for the objection.

  2. Work out the deadline and set a reminder

    A Widerspruch is usually due within one month after the decision was made known to you (Bekanntgabe). For decisions sent by ordinary post, the law generally treats them as received on the fourth day after posting (since 2025; it used to be the third), unless they arrived later. If the last day falls on a weekend or public holiday, the deadline moves to the next working day. If the Rechtsbehelfsbelehrung is missing or wrong, the deadline is generally one year.

    Tip: Do not count on the maximum. Aim to send the objection at least a week early; reasons can follow later.

  3. Check the decision line by line

    Compare the decision with your own records. Common problems are wrong personal details, a wrong period, income counted twice or wrongly, costs (such as rent) not fully accepted, missing documents the authority overlooked, or a calculation you cannot follow.

    You can ask the authority to explain its calculation or let you see your file (Akteneinsicht).

    • Names, address and reference number are correct
    • Period and start date are correct
    • Amounts and calculation can be followed
    • All documents you sent were taken into account
    • Reasons given match the facts
    • Note each point you disagree with and the evidence for it

  4. Write the Widerspruch (Formulierungshilfe)

    A Widerspruch must be in writing and signed, or recorded in person at the authority. A plain email is often not enough unless the authority offers an official online channel (the Rechtsbehelfsbelehrung says which). It does not need legal language.

    Formulierungshilfe (example wording, adapt it to your case):
    "Widerspruch gegen Ihren Bescheid vom [Datum], Aktenzeichen [Nummer]. Hiermit lege ich gegen den oben genannten Bescheid Widerspruch ein. Die Begründung reiche ich nach. Bitte senden Sie mir eine Kopie der Berechnung bzw. gewähren Sie mir Akteneinsicht. [Ort, Datum, Unterschrift]"

  5. Send it with proof of delivery

    The objection must reach the authority before the deadline ends; the date you post it is not enough. Good options: hand it in and get a receipt stamp on your copy, send it by Einwurf-Einschreiben, send it by fax and keep the transmission report, or use the authority’s official online channel (for example jobcenter.digital for the Jobcenter) and save the confirmation.

    Tip: Keep a copy of every page you send.

  6. Send your reasons and evidence

    Explain briefly why the decision is wrong and attach copies of your evidence. If you asked for the calculation or file first, send the reasons once you have it. If the authority sets a date for the reasons, meet it.

    Important: A Widerspruch does not always pause the decision. Some decisions, for example certain Jobcenter decisions, take effect anyway, and money demanded may still be due. Ask the authority or a counselling service whether you should apply for a suspension.

  7. Get free or low-cost help if needed

    7 days

    You can object without a lawyer, but advice helps for large amounts or complex cases. Options include independent benefit counselling (Sozialberatung) and welfare organisations, the Verbraucherzentrale, tenants’ associations for rent questions, trade unions for members, and lawyers. People on a low income can apply for Beratungshilfe at the local court (Amtsgericht) to get legal advice for a small fee.

  8. Watch for the outcome

    14 days

    The authority either corrects its decision (Abhilfebescheid) or rejects the objection (Widerspruchsbescheid). Processing often takes weeks or months. A rejection again contains a Rechtsbehelfsbelehrung, usually allowing a court action (Klage) within one month. Proceedings at the social courts are generally free of court fees for benefit claimants.

    If you hear nothing for a long time, ask for the status in writing and quote your reference number.
